Full Job Description
We are looking to recruit a Senior Prosecution Lawyer to join our Legal team. Ofsted's Legal Services team underpins delivery of our statutory functions. We work in specialist teams covering public law, judicial review, education law, children's social care law, regulatory enforcement and prosecutions. Ofsted has strong enforcement powers in Social Care and Early Years, including the authority to investigate and prosecute criminal offences. Our work is focused on tackling illegal and unregistered provision and protecting children from unsafe or unlawful settings. Enforcement Activity Includes:
- Unregistered schools, children's homes and childcare providers
- Obstruction of inspectors
- Breaches of registration conditions
- False or misleading information in applications
- Social care: failure to comply with compliance notices This work is central to safeguarding children and maintaining high standards of care and education., Reporting to the Deputy Director, Legal Services, you will:
- Provide or commission high-quality, accurate and cost-effective legal advice
- Support and oversee enforcement and prosecution activity
- Apply legal judgement to complex, sensitive and high-risk cases

- Managing a Quality Service Technical skills We'll assess you against these technical skills during the selection process:
- Proven experience conducting prosecutions or advocacy in the Magistrates' and/or Crown Courts, including presenting cases clearly and persuasively, making legal submissions, and managing contested hearings with confidence and professionalism.
- In depth knowledge and understanding of PACE, associated Codes of Practice, and experience advising investigators on lawful evidence gathering, interviews, and investigative conduct.
- Ability to assess evidence rigorously & provide early investigative & charging advice in accordance with CPS prosecution guidance & Code for Crown Prosecutors, with a track record of making sound, evidence based decisions in complex/sensitive cases.
- Experience of designing and delivering legal training to support investigators and disclosure officers, with a particular focus on ensuring compliance with the Criminal Procedure and Investigations Act 1996 and associated disclosure obligations.
- Knowledge, understanding and practical application of the Regulation of Investigatory Powers Act 2000 (RIPA) in relation to directed surveillance. (desirable)
- Proven in house or regulatory prosecution experience supporting lawful, proportionate and compliant investigative activity. (desirable) We only ask for evidence of these technical skills on your application form:

Benefits Alongside your salary of £85,850, Office for Standards in Education, Children's Services and Skills contributes £24,870 towards you being a member of the Civil Service Defined Benefit Pension scheme.
